Registration of Property Rights in Kyiv: 2026

How a notary registers ownership of an apartment, house or land plot in Ukraine, which documents are required and what registration costs in 2026.

What state registration of ownership means

Registration of ownership: a record in the State Register of Real Rights, not a signature on a contract

Ownership of an apartment, house or land plot does not arise from a signature on a contract — it arises from the moment of state registration. Article 210 of the Civil Code of Ukraine states that under a contract subject to state registration, the right arises from the moment it is carried out. Article 182 of the Civil Code refers ownership and other rights in rem to immovable property to state registration.

Registration does not create new rights and does not replace the contract. It records in the State Register of Real Rights who owns the property, on what basis and with which encumbrances. Without the record the new owner cannot sell the property, mortgage it or register a place of residence there.

When the registration is performed by a notary

The notary enters the record together with certifying the contract

A notary is a subject of state registration of rights in rem: the notary enters records in the State Register while performing a notarial act. Most often this happens together with certifying a contract or issuing a certificate of inheritance — there is no need to visit a state registrar separately.

The most common grounds are property rights registration, a certified apartment sale and purchase agreement and, where the property is jointly owned, a spousal consent statement.

Which documents are required

Documents for registration of ownership: passport, contract, technical passport, spousal consent
  • Passport and tax number of the applicant; a power of attorney for a representative.
  • A title document: a contract, a certificate of inheritance or a court decision.
  • A technical passport or an extract from the technical documentation for the apartment or house.
  • For a land plot: an extract with the cadastral number and a document confirming ownership or use.
  • Consent of the other spouse where the property was acquired in marriage and only one spouse disposes of it.
  • A receipt confirming payment of the state fee.

The exact list depends on the ground for registration: inheritance requires death and kinship documents, while a contract requires the contract itself and spousal consent.

How much registration costs in 2026

The cost of property rights registration in 2026: a UAH 330 state fee

The state fee is tied to the subsistence minimum for able-bodied persons — UAH 3,328 in 2026. State registration of ownership within the standard period of up to five working days costs UAH 330. Shortening the period raises the fee: UAH 6,660 for one working day and UAH 16,640 for two hours.

Registration of other rights in rem within the standard period costs UAH 170. Information from the register costs UAH 80 on paper and UAH 40 electronically, and correcting a technical error made by the applicant costs UAH 130.

Deadlines and grounds for refusal

Registration deadlines and checking encumbrances before signing

The standard period is five working days from submission of documents and payment of the fee. Shorter periods — one working day or two hours — are available at a higher fee.

  • The property is subject to an arrest, mortgage or other encumbrance that was not disclosed.
  • The area, address or owner details in the documents do not match the register.
  • There is no consent of the other spouse to dispose of jointly owned property.
  • The state fee has not been paid or was paid to the wrong account.
  • The document does not meet legal requirements or has been cancelled.

Registration may be suspended so that the applicant can remedy a defect. A refusal is issued as a decision of the state registrar and can be appealed to the Ministry of Justice or to a court.

How registration works step by step

  1. Check the property in the State Register of Real Rights: owner, encumbrances, arrests.
  2. Clarify the ground for registration and the full list of documents for your case.
  3. Prepare the original documents and spousal consent if required.
  4. Pay the state fee for the chosen period.
  5. Sign the application at the notary: the notary checks the documents and enters the record in the register.
  6. Obtain an extract from the State Register and verify your details and the absence of extra encumbrances.

Frequently asked questions

Frequently asked questions

Can ownership be registered without a notary?
Yes, by applying to a state registrar or through an administrative services centre. If the right arises from a contract that must be notarised, the notary performs the registration together with the certification.
How long does the register entry take?
Five working days as standard. For an additional fee the period is shortened to one working day or two hours.
What happens if ownership is not registered?
The buyer does not become the owner in the legal sense: they cannot sell the property, mortgage it or register a place of residence. The risk of losing the property remains with the previous owner.
Is spousal consent required if the apartment is registered to one person?
Yes, if the property was acquired in marriage and is considered joint. Without a notarised consent the contract may not be registered.
Is the state fee included in the notary's fee?
No. The fee is paid separately for the registration action, while the notarial tariff covers the notarial act itself.
